Faadaakaa.com is only accessible to persons that are legally capable of entering into legally binding contracts under Nigerian law. Thus persons below the age of 18 are not permitted to have an account or transact or use the Faadaakaa.com website. If you are a minor and wish to use or transact on Faadaakaa.com, you may do so through your legal guardian or parents who have registered as Faadaakaa.com users. We do not knowingly transact business with or offer services to children under the age of 18.

Registration and Account

To take advantage of the services we offer on Faadaakaa.com, you have to register  for an account by filling and submitting the registration form on the website. You represent and warrant that all information provided in the registration form is complete and accurate. Every account owner is solely responsible for keeping passwords and other account identifiers safe and secure and is entirely responsible for all activities that occur using his/her password or account.

Loan Payment Transactions

Faadaakaa.com's essential feature is providing loans to account holders in order for them to make purchases from the Faadaakaa.com website and pay off the loan in installments. The following rules must be followed in order for an account holder to benefit from this service:

  1. You must enter your bank account information in order for your credit value to be generated, which will determine the maximum amount that Faadaaka.com can loan to you to make product purchase.
  2. You will be loaned the maximum amount only when you fill out all of the required information, such as your BVN, NIN, and International Passport Data Page or regulatory ID Card.
  3. You must fill the credit/debit card information that is linked to the bank account that was valued in order for Faadaakaa.com to debit your account in accordance with the payment plan selected.
  4. 40% of the price of the item to be purchased must be paid by the account holder and the remainder  60% will be loaned to you by Faadaakaa.com.
  5. You warrant that you will ensure that your bank account has sufficient funds to allow Faadaakaa.com  debit your account in accordance with the payment plan you have chosen.
  6. All items purchased with a loan remain the property of Faadaakaa.com until the final payment is made. Following that, Faadaakaa.com will issue you a purchase receipt.
  7. Faadaakaa.com reserves the right to withdraw the purchased item from the location where it was delivered if the account holder fails to fund his account.

Electronic Communications

When you use Faadaakaa.com or send e-mails or other communications to us, you agree that you are communicating with us electronically and you consent to receiving communications from us electronically. You may keep copies of these communications for your records. You agree that all agreements, notices, disclosures, and other communications provided to you electronically meet any legal requirement that such communications be in writing.

Intellectual Property

All intellectual property rights and database rights, whether registered or unregistered, information content and all the website design including, but not limited to, text, graphics, software, user and visual interfaces, photographs, video, music, sound, artwork,and their selection and arrangement, and all software compilations, underlying source code and software on Faadaakaa.com is owned,controlled or licensed by or to us, and is protected various intellectual property rights and unfair competition laws. We make every attempt to deliver goods within the estimated delivery periods listed on our website; but, delays are sometimes unavoidable due to unforeseen circumstances. If the delay or failure to deliver the products within the anticipated timeframes was not caused by our fault or negligence, we will not be liable.

Applicable Law

These Terms & Conditions shall be interpreted and governed by the laws of the Federal Republic of Nigeria. Lagos, Nigeria will be the sole venue for the proceedings.

Legal Dispute

We will make every attempt to resolve all disagreements amicably. Any dispute arising out of these Terms & Conditions that cannot be resolved by mutual agreement/negotiation within 1 (one) month will be referred to Arbitration by a single Arbitrator at the Lagos Multi-Door Courthouse ("LMDC") and governed by the Federal Republic of Nigeria's Arbitration and Conciliation Act, Cap A10. The Arbitrator will be chosen by both parties, and if neither of us can agree on an Arbitrator, the choice of Arbitration will be transferred to the LMDC. The Arbitrator's findings and eventual award will be binding on both of us. Each of us will be responsible for our respective costs in connection with the Arbitration. Venue for the arbitration shall be Lagos, Nigeria.

Severability

If any portion of these Terms and Conditions of Sale is found to be invalid or unenforceable by a court or tribunal, in whole or in part, that portion shall be severed from these Terms and Conditions of Sale and will shall not affect the validity or enforceability of any other section listed in this document.
